5. Prizes and Rewards
Users may offer prizes for certain spins, especially in follower or world giveaways. The following terms apply to prizes:
Organizer’s Responsibility If you initiate a spin offering a prize (monetary or non-monetary), you are solely responsible for providing and fulfilling that prize to the winner. Spinras is a facilitation platform; the obligation to deliver the promised prize lies with you as the contest organizer. Ensure that you only promise prizes that you can and will deliver.
Taxes and Legal Obligations: Any taxes, duties, or regulatory obligations resulting from a prize are the responsibility of the prize giver and/or the winner. If you are an organizer, you are responsible for determining if your prize requires any tax reporting or if the winner needs to meet any eligibility requirements. In certain jurisdictions (for example, in the U.S.), you may be required to provide tax documentation to winners of high-value prizes (e.g. issuing a IRS Form 1099 for prizes over a certain value). Spinras is not responsible for calculating or withholding any taxes on prizes. We do not provide legal or tax advice; please consult your advisors to ensure compliance.
Winner Obligations If you are a winner, you may be asked to provide additional information to claim your prize (such as a mailing address for a physical item, or payment account details for cash). By accepting a prize, you acknowledge that any personal information you provide for prize fulfillment may be shared with the organizer and handled according to our Privacy Policy. If you do not claim your prize within the time specified by the organizer or Spinras, the organizer may choose an alternate winner or cancel the prize at their discretion.
No Prize Substitution Prizes must be awarded as described. Organizers should not substitute the prize for something of lesser value without the consent of the winner. Likewise, winners cannot demand a different prize or cash equivalent unless offered by the organizer.
Prohibited Prizes You may not offer any prize that is illegal, hazardous, or violates any third-party rights. Spinras reserves the right to disallow or remove any contest offering a prize that we deem inappropriate or unlawful.
Failure to Deliver If an organizer fails to deliver a promised prize, that is a breach of these Terms. Spinras may, at its sole discretion, take actions against the offending organizer's account (such as suspension or termination) to maintain the integrity of the platform. However, Spinras is not liable to the winner for an organizer’s failure to provide a promised non-monetary prize. Any dispute regarding prize fulfillment is between the organizer and the winner, though Spinras may attempt to facilitate communication or resolution.
